I would love too call them up but i have no idea who they are. Didnt the person who hit you give you insurance details at the scene ?

I wrote it down and gave it to the solicitors but cant remember off the top of my head. Funnily enough i sent the emails to the solicitor with details of her name etc but my sent folder hasnt got the message anymore 😠so im powerless.

I'm going through my own small claims fiasco at the minute as the claimant, so I can totally understand why you're frustrated at the amount of time it's taking to sort out. When the incident happened, and you took pictures... do you have her reg number? Did you take her full name? Address? Phone number? I know these aren't necessarily things we all think of when a horrid thing like this happens, but if you've got any of that info, it's a good place to start. Can you ask your insurance company who her insurance company is? To contact them off your own back, as a previous poster suggested? Did you get hold of the CCTV video? Sorry, lots of questions, but I want you to get from this what you should! Meg x

I got her full name and address too. I sent it all to green light and the solicitors green light provided. It all took so long that even if there was cctv it wouldve been wiped by the time they did anything.. they didnt ask me anything about it. I did mention it to them. There was no police involved which was my downfall. I was determined to still get to work and the cars damage is only cosmetic.. wish id called the police!! Ive litetally done all they asked.. her insurance company is just not responding!! This could be going on for a few years!!

Have you written them a letter (and sent it Recorded Delivery) to state that unless they respond in, say, 10 working days, you will be referring the matter to the Insurance Ombudsman?
I'm led to believe that does get things moving!

Got a call today from the solicitors car damage inspectors today. Thats some progress.. i hope they dont wanna write it off. Might have to have a chat with the inspector. I can get a rear quarter panrl for 70 to 90 quid and a door for 30 quid or so. Theyd just need spraying and the rear quarter welded in. Get a cheeky bit of rust sorted whilst im there. Totalmx5repair should be able to do the work for a great price. I wouldnt trust anyone else to fo the work to be honest.. hopefully i can have some input into the repairs.
I dobt want it to be written off because a usual body shop quotes it at 1500 for repair!

The inspector will work out 'normal' bodyshop rates and decide on that - so if it's 1500 quid, it'll probably be a write off! Doesn't mean it can't go back on the road, though, but you'll need to ask what the processes are if it is written off. You can normally buy Cat D or C write-offs back off the insurance company for a reasonable amount and get the work done, leaving you cash in pocket If they do have to take it away before you can do that, get all the expensive or non-OEM bits off it first!

They will 100% write it off. It’s how it pans out after that initial assessment you want to focus on.
Insurance estimates always use new and OEM parts where possible as they have to warranty the repairs. They won’t wver quote on picking up used bits from eBay and painting those up.

You might get the option of buying the car back as a Cat D (or Cat N, I think they changed the classifications last year), which means there is no structural damage, but it's economically not viable for the insurance company to repair. You'll normally end up with some money in your pocket from the payout if that's the case, as you can buy the car for scrap value.

MX5s are still gaining value and if you can document and prove the damage wasn't that bad, and that the repair is good, any serious buyer wouldn't be put off.

Ive heard tales of not being able to buy your car bac And parts being taken off your car after its been written off. Im worried about the insurance sky rocketing. I already pay 500 a year and that went up as soon as the woman drove into me
